RCR Attorney Max McHugh recently obtained summary disposition in favor of a vehicle owner who was sued for injuries arising out of a car accident. Recovery under MCL 500.3135 requires Plaintiff to demonstrate some impact on her general ability to lead her normal life before she can recover on a tort claim. Max successfully proved that, although Plaintiff had an objective injury (a fractured wrist), her injuries did not amount to a serious impairment of a bodily function and thus, claims against Max’s client were dismissed with prejudice.
RCR Attorney Janine Plourde recently obtained summary disposition in favor of a vehicle owner who was sued for injuries arising out of a car accident that allegedly involved her vehicle. Under Michigan law, a vehicle owner can be held 100% liable for injuries in such cases. But Janine successfully proved that her client had not consented to the use of her vehicle and, as such, the claims against Janine’s client were dismissed with prejudice.
