Recent News
SD Victory
RCR Attorney Max McHugh recently obtained summary disposition in favor of a vehicle owner who was sued for injuries arising out of a car accident. Recovery under MCL 500.3135 requires Plaintiff to demonstrate some impact on her general ability to lead her normal life before she can recover on a tort claim. Max successfully proved that, although Plaintiff had an objective injury (a fractured wrist), her injuries did not amount to a serious impairment of a bodily function and thus, claims against Max’s client were dismissed with prejudice.
SD - No Insurance
Max McHugh was able to obtain summary disposition of a third-party claim arising out of an automobile accident. Max successfully argued, despite Plaintiff’s attempts to muddy the waters, that Plaintiff did not have the security required pursuant to MCL 500.3135. Max argued successfully that the Plaintiff was trying to perpetuate fraud and that the claims did not survive the scrutiny required under MCR 2.116.
Permissive Use SD Victory
Max McHugh successfully argued for the dismissal of Plaintiff’s owner’s liability claim asserting that Co-Defendant was not a permissive user of the vehicle involved in the subject motor vehicle accident and that the use of the vehicle occurred without Defendant’s knowledge or consent. The Court dismissed Plaintiff’s claims with prejudice.
